COOKIE POLICY
Regulation (EU) 679/2016 General data protection regulation.
The website www.yuccs.com uses cookies and similar technologies for the following purposes:
- enable the correct functioning of the Website and the provision of the relevant services;
- perform aggregate statistical analysis to understand and improve the user's browsing experience (e.g. counting the number of visitors to the Website, understanding the popularity of a product or a service, etc.);
- analyze the preferences and navigation of users who visit the Website in order to send them advertising according to the preferences expressed while browsing the website and to personalize the contents.
The information below refers both to the use of cookies and to other tracking tools that may be used (unless otherwise indicated). For the sake of practicality, we will use the term "cookies" to refer to all the various tracking technologies, except where expressly stated otherwise.
Pursuant to Article 13 of Regulation (EU) 2016/679 General Data Protection Regulation (the "Regulation") and Directive 58/2002 and its subsequent amendments and supplements, Simply Merino SL in its capacity as data controller, provides the following information.
1. What is a cookie?
Cookies are text files that are sent from a web server (i.e. the computer where the visited website is "hosted") to the user's browser (Microsoft Edge, Mozilla Firefox, Google Chrome, Opera, Safari, etc.) and stored on the device, fixed or mobile, used for the user's navigation. The cookie allows the Website to identify the user's device, through the information stored on it, each time the user reconnects to the Website through that device.
By using cookies (or other tracking tools) we can facilitate the user's navigation of the Website, as well as analyze preferences and tastes through the verification of navigation (profiling activities) and, consequently, offer a promotion of products and services more in line with the user's interests and expectations (for example, by displaying advertisements in line with their interests).
Cookies can be "session" (when they are stored only for the duration of the browsing session on the website and are deleted when the browser is closed), or "persistent" (they are stored for a longer period of time, until they expire or are deleted by the user). In addition, cookies or other tracking tools may be "first-party" (when they are created and used solely by the owner of the website that issued them and are not transferred to third parties) or "third-party" (when they are issued and managed by parties other than Yuccs).
An example of other tracking tools are "tracking pixels", small pieces of code embedded in the website that, once downloaded to the user's browser, allow the social media provider (e.g. Facebook) to monitor the user's session, collecting data for user analysis and profiling.
Cookies and tracking tools do not collect information that directly identifies the user.
2. Types of cookies (or tracking tools) used by the Website
Technical or necessary cookies and tools
These are cookies used to ensure navigation and, therefore, the telematic transmission of data on the network or strictly necessary for the provision of the services offered by the Website.
These cookies can be of both origin and third parties and do not require obtaining the prior express consent of the user, as they are strictly necessary to provide the service requested by the user of the Website.
Analytical Cookies
Analytical cookies, also those of third parties, allow us to understand how users use the Website. These cookies do not collect information directly attributable to your identity or personal data. The information collected is usually processed in an aggregated and anonymous form through the use of partial IP masking mechanisms; these cookies, in the presence of other security measures and minimization of processing, are equivalent to technical cookies and do not require the user's prior consent.
On the other hand, if, for example, such masking mechanisms do not exist, the use of these cookies will require the user's express and informed consent.
Personalization Cookies
The so-called "personalization" cookies make it possible to record the user's preferences when using the Website (e.g. the language chosen and the country of interest) or to facilitate the user's navigation within the Website (e.g. by remembering the data provided by the user), remembering the data provided by the user when filling in forms on the Website (user input cookie), to recognize the user after he/she has logged on to the Website (authentication cookie); these are tools not strictly necessary for navigation on the Website and, if kept even after the browser has been closed, they require the prior and explicit consent of the user. Such cookies can be both first-party and third-party cookies.
Profiling (or marketing) cookies.
These are cookies designed to create user profiles, for example, in order to send you advertising that matches your preferences (for example, by using these cookies, you will be able to see advertisements for products in which you have expressed interest on other websites). They may be first-party or third-party; session or persistent.
Other tracking tools (e.g., Facebook pixels) also work in a similar way (e.g., allowing ads to be displayed on the social network).
The use of these cookies and tools requires the user's express and informed consent.
Consent will only be requested from you when you first access the Website: thereafter, we will use a technical cookie to store your consent so that you can directly access the Website pages when you return. It is understood that your consent may be withdrawn at any time in the manner specified in section 3 of the Cookie Policy.
Other profiling tools are not used in the absence of user consent (e.g. spyware).
Third Party Cookies
The Website uses both cookies and tracking tools called "first-party", i.e. issued by Yuccs and by the Website, and cookies and tracking tools called "third-party" (e.g. Google Analytics, social network cookies, etc.), i.e. tools that are issued and managed by subjects other than Yuccs.
On the Website you can also find social buttons/widgets (social network modules), i.e. particular "buttons" that represent the icons of social networks such as Facebook, Instagram, Twitter, etc. These buttons allow users who are browsing the Website to access and interact with a "click" directly with social networks. For more information, please see section 8.
3. Your consent
When accessing the Website, the user will see a banner warning about cookies and other tracking tools that may be used.
The banner provides summary information so that the user can understand what cookies/tools are used and for what purposes; moreover, by using the "settings" button the user can also check in detail what types of cookies and tools are used. Therefore, the user is free to choose whether to allow cookies and other tracking tools and which ones.
We will remember whether the user has given or refused consent to allow direct access to the pages of the Website without having to view the "banners" again, except in particular cases
(e.g. if the user deletes cookies, if users need to be updated regarding the cookies used, etc.).

4. Disabling/deleting cookies via your web browser
In any case, you can disable/enable or delete cookies through your web browser settings. In particular, if you do not wish to receive cookies, you can set your browser to notify you of the presence of a cookie so that you can decide whether to accept it or not; you can also automatically reject all cookies by activating the corresponding option in your browser. Finally, you can also delete specific cookies that have already been stored in your browser, block specific websites from storing cookies on your computer or block third-party cookies.
Each browser (Firefox, Chrome, Edge, Safari, Safari, Opera, etc.) has its own method of managing cookies: in the settings panel or in the preferences you can modify/manage the parameters relating to cookies or proceed to their deletion. To do this, it is necessary to consult the information included in the user manual of the browser (called Help Page) or click on the following links:

5. Who will have access to your data
Data collected through cookies and other tracking tools will not be disclosed to the public and will be processed by specifically authorized persons within Yuccs (in particular, within the customer relationship management, e-commerce, marketing and information technology departments).
For the purpose of managing the Website and, if you give your consent, analyzing your preferences, your browsing and allowing you to view promotional content and advertisements that may be of interest to you, the data will be processed by i) companies in charge of managing the Website and ii) IT service providers. These persons will act as Data Processors appointed by Yuccs.
5.1 Social networks
Data relating to navigation on the Website may in some cases be transmitted to social networks (such as Facebook, Instagram, etc.; you can consult the table below for a list of social networks that interact with the Website). In general, the interaction between a Website and the social network is used, for example, to:
- allow you to log in using the social network (e.g. when you choose to log in to the reserved area of the Website using Facebook, there is an exchange of data between the social network and the Website to allow user recognition and authentication);
- allow the exchange of content on social networks (e.g. if you use the sharing function - the so-called social plug-in - it will be possible to publish, and therefore share, content of interest within your profile on the social network);
- display promotional and advertising content when visiting social networks (e.g., social networks may display advertisements relating to the Yuccs brand and products that have been viewed within the Website). This may be done mainly through two procedures:
- data relating to the user's navigation within the Website and collected through cookies or other tracking tools will be shared with social networks, which, by identifying the user, will display advertising content to the user, then providing Yuccs with statistics on the advertising campaigns carried out;
- if the user has provided his/her e-mail address, the data may be shared (in encrypted and protected form) with the social network, which, by identifying the user via e-mail, will show him/her advertising content, providing Yuccs with statistics on the advertising campaigns carried out.
For such processing, the social networks will process the data - in their capacity as co-processors (art. 26 of the GDPR) - to the extent necessary to enable, for example, the display of news or advertising relating to Yuccs.
Below is reproduced information on the processing carried out by the social networks present within the Website:
Facebook (e.g. Facebook, Instagram), the co-responsible for the processing is Meta Platforms Ireland Ltd. 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland. A co-responsibility agreement (art. 26 of the Regulation) governs the processing of personal data carried out using the tracking tools provided by Facebook and present on the Website: the agreement sets out the respective responsibilities in relation to the respect of the obligations under the Regulation regarding joint processing.

Facebook, on the other hand, is autonomously responsible for the further processing of user data. As the controller, it is the responsibility of Facebook to provide data subjects with information on the processing carried out or to allow the exercise of confidentiality rights (Articles 15-20 of the Regulation). The Website uses cookies and Facebook tracking tools (e.g. pixels) to i) show users personalized promotional and advertising content, ii) provide statistical reports on advertising campaigns and user navigation on the Website, iii) improve the publication of content on the Website.
For these purposes, data relating to user navigation within the Website and collected through cookies or other tracking tools will be shared with Facebook. https://www.facebook.com/about/privacy.
You can find details on how Facebook treats the data, the corresponding legal bases of the processing and how to exercise the confidentiality rights granted by the Regulation against Facebook.

6. What are your rights
By writing to soporte@yuccs.com you can at any time exercise your rights under articles 15 to 22 of the Regulation, among others:
- obtain confirmation as to whether or not personal data concerning you are being processed;
- obtain access to your personal data (for example, by consulting what data is being processed, for what purposes and in what manner);
- obtain the rectification of inaccurate personal data or the completion of incomplete personal data;
- obtain the deletion of your personal data (in the event of the appropriate circumstances);
- obtain the restriction of the processing of your personal data (in the event of the relevant circumstances);
- receive your personal data in a structured, commonly used and machine-readable format (if applicable).
You can also always object to the data processing carried out, in particular for analysis and profiling or marketing purposes, as well as withdraw your consent (see paragraph 3 and paragraph 8 below).
7. Transfer of data outside the European Union
Generally, data collected through the Website are not transferred abroad, as the processing operations are carried out by providers using servers located in the European Union (or in the European Economic Area).
On the other hand, data collected using cookies and other tracking tools - in particular those of social networks - may be transferred outside the European Union (e.g.: data collected through Facebook tracking tools are subject to transfer). The applicable privacy rules provide that no specific consent is required for the transfer when the transfer is made to a country that ensures an adequate level of protection (art. 45 of the Regulation) or pursuant to the adoption of adequate safeguards (articles 46 and 47 of the Regulation) and in particular pursuant to the adoption of binding rules for groups of companies or the adoption of contractual clauses approved by the European Commission: the transfer of data collected through cookies/tracking tools is regulated by such contractual clauses (z.B. https://www. facebook.com/help/566994660333381?ref=dp).
